Terms of Use
These terms govern your use of the Valorstead website and services. Please read them carefully, because by using the website or opening an account you agree to them.
Valorstead is an information and technology platform. The website is informational and promotional in nature. Any trading takes place under the terms of the services you accept when you open an account, with the entity that provides them.
1. Use of the website and services
You may use the website and the platform for lawful purposes only and in line with these terms. You must be at least 18 years old, have the legal capacity to enter into a contract and give us accurate information. You are responsible for keeping your credentials confidential and for what happens under your account.
2. Restrictions
You may not copy, resell, reverse engineer or attempt to extract source code from the platform. You may not use automated tools to scrape the website, interfere with its operation or access areas that are not intended for you. We may restrict access where we reasonably suspect a breach of these terms.
We may suspend, change or withdraw any part of the platform, for example for maintenance, security reasons or because a feature is retired. Where we can, we will give notice. Your use of an exchange or a third-party payment service is subject to that provider's own terms.
3. Promotional material and newsletters
We may send you information about our services and offers if you have agreed to receive it. Promotional material is general in nature and is not personal advice. You can unsubscribe at any time through the link in a message or by writing to us.
4. Intellectual property
The website, its design, text, graphics, software and the Valorstead name and logo belong to us or our licensors and are protected by copyright and other laws. You get a limited, personal, non-transferable licence to view and use the site for its intended purpose, and no other rights are granted.
You may not use our name, logo or content in a way that suggests we endorse you, or create a site that could be mistaken for ours. Feedback and suggestions you send us may be used without obligation to you.
5. Privacy
How we handle personal information is described in our Privacy Policy, which forms part of these terms. By using the services you acknowledge that you have read it.
6. Links
The website may contain links to other sites that we do not control. A link is not an endorsement, and we are not responsible for the content, accuracy, security or practices of those sites. You use them at your own risk.
7. Prohibited use
You must not use the services to break the law, to commit fraud, to launder money or finance terrorism, to send spam or malicious code, to attack or overload our infrastructure, to impersonate another person or to infringe someone's intellectual property rights. We may suspend or close an account and report the matter to authorities where we have reasonable grounds.
We may remove content, suspend access or close an account without notice where we think it is necessary to protect customers, the platform or the law, and we will give you the reason unless the law prevents us from doing so.
8. Support
Support is available through the contact details on our Contact page, during the hours stated there. We aim to respond promptly, and response times are targets, not guarantees.
9. Disclaimer of warranties
Information and tools on the website are provided for general information only and "as is". We take care to keep them accurate and current, but we do not warrant that they are complete, error-free or suitable for your purposes. Nothing on the website is a recommendation or personal advice, and past results do not predict future ones. Nothing in these terms excludes any consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.
10. Limitation of liability
To the extent the law allows, we are not liable for loss or damage arising from your use of, or inability to use, the website, including trading losses, loss of profit, loss of data or indirect and consequential loss. Where liability cannot be excluded, it is limited to the extent the law permits, and where it can be limited, to resupplying the service or paying the cost of having it resupplied.
11. Indemnity
You agree to compensate us for loss or expense that we incur as a result of your breach of these terms or your breach of the law, including reasonable legal costs, to the extent that the law permits.
This indemnity does not apply to loss caused by our own negligence or breach, and does not limit any right you have under the Australian Consumer Law.
12. General
These terms are governed by the laws of New South Wales, Australia, and the courts of that state have non-exclusive jurisdiction. If a provision is unenforceable, the rest continues to apply. We may change these terms from time to time, and the changes take effect when the updated version is published on this page. Continued use after that date means that you accept them. Questions about these terms can be sent to [email protected].
